Terms of Use
1. Agreement to these terms
These Terms of Use ("Terms") govern your access to and use of Pedro's Nightmare (the "Service"), including our website, member portal, scripts, keys, Discord bot, community servers, and related tools. By logging in, accessing, or using the Service, you agree to these Terms, our Privacy Policy, and our Disclaimer. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using it, you confirm that you meet this requirement. The Service is not intended for children.
3. Accounts and Discord sign-in
Access requires signing in with your Discord account. You are responsible for your Discord account and all activity that occurs under your access. Do not share your account or access with anyone. We may refuse, limit, suspend, or revoke access at our discretion, including for suspected fraud, abuse, or violation of these Terms.
4. Nature of the products
We provide independently developed scripts, configurations, keys, and related tools for use with third-party controller hardware such as the Cronus Zen. These products are unofficial and are not provided by, affiliated with, or endorsed by any game publisher, platform, or hardware maker. See our Disclaimer for important risk information, including that use may violate third-party terms and may result in bans or other enforcement action, for which you assume full responsibility.
5. License, not sale
Your membership grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use our scripts and keys for your own private, non-commercial use only. You do not own the scripts, and no ownership is transferred to you. You may not:
- share, resell, sublicense, rent, lend, publish, or redistribute any script, key, serial, or your access;
- copy, modify, reverse-engineer, decompile, or attempt to extract source code or algorithms from our products;
- use the Service for any commercial purpose; or
- use the Service in any unlawful manner or to infringe the rights of others.
6. Membership and access
Access to keys and member features is tied to an active membership with a valid registered serial and, where applicable, an expiration date. When your membership expires, access to member-only features ends until it is renewed. We may add, change, or discontinue features at any time.
7. Serial registration and keys
Certain features require you to register a device serial and to generate keys tied to that serial. Serial registration and key generation may be logged and rate-limited to prevent abuse. Serials associated with fraud, chargebacks, sharing, or other violations may be banned, which will prevent key generation and access.
8. Payments and refunds
Memberships are sold as digital products with immediate access. All sales are final. The only exceptions are genuine billing errors. For full details, including how chargebacks are handled and the rights of EU/UK customers, see our Refund Policy, which forms part of these Terms.
9. Chargebacks
If you believe there is a billing problem, contact us first. Initiating a chargeback or payment dispute without contacting us may result in immediate and permanent revocation of your access and a ban of your account and serial, in addition to any other remedies available to us.
10. Acceptable use
You agree not to misuse the Service, including by attempting to gain unauthorized access, interfering with or disrupting the Service, scraping or automating access, uploading malicious code, impersonating others, or violating any applicable law.
11. Intellectual property
All content, scripts, code, designs, and branding of Pedro's Nightmare are owned by us or our licensors and are protected by intellectual-property laws. Third-party names and trademarks belong to their respective owners and are used for identification only.
12. Disclaimers and limitation of liability
The Service and all products, scripts, keys, and tools are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, as described in our Disclaimer. You use the Service entirely at your own risk. To the fullest extent permitted by applicable law, Pedro's Nightmare, its owner, operators, team, and affiliates will not be liable for any damages of any kind arising out of or connected with your access to, use of, or inability to use the Service — including any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, and any loss of profits, data, accounts, goodwill, hardware, bans, or other losses — even if we have been advised of the possibility of such damages. Where liability cannot be excluded as a matter of law, our total aggregate liability for all claims relating to the Service is limited to USD $10 (or the minimum amount required by applicable law).
13. Indemnification
You agree to indemnify and hold harmless Pedro's Nightmare from any claims, damages, or expenses arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights or terms.
14. Termination
We may suspend or terminate your access at any time, with or without notice, for any reason, including violation of these Terms. Provisions that by their nature should survive termination will survive.
15. Changes to these Terms
We may update these Terms from time to time. Changes take effect when posted, and your continued use of the Service means you accept the updated Terms.
16. Governing law
These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-law rules.
